These conditions of sale have as their object the viewing and purchase of airsoft items, carried out through the calicojack.it website managed by Calico Jack Airsoft sas with headquarters in Via G. Galilei 4 - 20835 Muggiò (MB) - Italy, registered in the Monza and Brianza Company Register with number MB-1854498 and with VAT number IT-06016910967.

Access to the Site and use of the same by visitors (the "User" or "Users") is subject to these Conditions of Use and Sale, as well as any changes or additions made to them.
By using the Site and accepting the Conditions of Sale during the order phase, you are bound by the same. Anyone who does not wish to accept the Conditions of Use and Sale and be bound by them must refrain from using the Site and placing online orders. By accepting these Conditions of Use and Sale through the use of the Site, the user declares that he or she is at least 16 years of age or older. If the user or users are under 16 years of age, he or she may use this site only under the supervision of a parent or legal guardian who agrees to be bound by these Conditions of Use. Terms of Sale and Purchase Methods

Given that, orders placed on the site www.calicojack.it are processed by Calico Jack AirSoft s.a.s. with registered office and operations in Muggiò (MB) in Via Galileo Galilei 4, hereinafter referred to as "Calico Jack".

The contract stipulated between Calico Jack and the Customer must be considered concluded with the acceptance, even partial, of the order by Calico Jack. Such acceptance is considered tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions described below.

The Customer, once the online purchase procedure has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance selling.

The order on the calicojack.it site can only be placed by adult users as it is a contract valid for all legal purposes, therefore Calico Jack will not be held responsible for the sale of products with limitations such as softair replicas +16 etc..

All items in our catalog, unless otherwise specified, are compliant with the law for the Italian market, in the case of orders and shipments to foreign countries (EU, Extra EU) please inquire about the laws of the country of destination as we will not be held responsible for any violations, but these will fall on the buyer for the careless purchase.

Calico Jack declines all responsibility for any damage or injury resulting from the proper or improper use of any item purchased from Calico Jack. The user is required to use such items responsibly and at his own risk, if resident outside Italy he must also inform himself about any regulations of the country of destination.

The Customer can only purchase items present in the Calico Jack Softair electronic catalog at the time of placing the order and viewable online at www.calicojack.it, as described in the relevant information sheets. It is understood that the images accompanying the description of an item, especially replicas (including any optional accessories or various documentation, whether or not present in the packaging of the replica itself), may in some cases differ slightly or vary from what is described and illustrated on the site. These differences are due to the different production batches and the commercial policies of the manufacturers. However, they may only concern aesthetic parts, such as the presence or absence of logos, optional or various documentation, which however do not affect the quality and above all the functioning of the product. All information supporting the purchase is to be understood as simple generic information material, not referable to the real characteristics of a single product, therefore they cannot be a reason for return.

The prices for online sales may be different from those for sales in the physical store.

Correct receipt of the order is confirmed by Calico Jack via an email response, sent to the email address provided by the Customer. This confirmation message will report the Date and Time of execution of the order and an 'Order Number', to be used in any further communication with Calico Jack. The message will reiterate all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.

Orders are processed by date and time of arrival ... and in any case always only after receiving confirmation of payment. Orders are usually processed within three working days (except for delays due to an intense amount of work such as during the BLACK FRIDAY period, Christmas, during the Summer Holidays and in any case with timing no later than 7/10 working days), except for setbacks not resulting from our will.

Items for sale with the wording "ORDERABLE IN 4/5 DAYS or ONLY ON ORDER WITHIN 7 DAYS" are goods available only ON ORDER by the customer, available at our office on average in 2/7 working days (depending on the various suppliers), only after the order has been processed and paid for and subject to actual availability from the supplier.

Items for sale with the wording "AVAILABLE IN WAREHOUSE or AVAILABLE ONLINE ONLY" are goods available ONLY for online sale and NOT available at our Muggiò office, but available at our Cambiago warehouse or goods available in our retailers' warehouses, available at our office on average in 2-7 working days (depending on the various suppliers), only after the order has been processed and paid for and subject to actual availability from the supplier.

Calico Jack assumes no responsibility for any delays beyond its control.

The availability of items in the STORE is updated approximately every hour and is indicated with the wording "AVAILABLE IN STORE". To streamline shipping times, if an item is currently out of stock and cannot be found in the near future, Calico Jack reserves the right to cancel the missing item from the order and send the remaining items to the customer (unless otherwise specified by the customer during the order process). If two or more items are out of stock, Calico Jack will inform the customer that they have the right to modify (with any alternatives) or cancel the order.

Items for sale with the wording "OUT OF STOCK" are goods that are currently unavailable in-store or from our suppliers. We recommend our customers enter their email address in the appropriate box on the item page in question to be notified promptly as soon as the desired item is available for sale again.

For technical and organizational reasons and above all to take advantage of ONLINE DISCOUNTS, Calico Jack will not have any collection commission, does not assume any responsibility for any shipments (described better later) and orders under 50.00 euros will not be accepted. Furthermore, always for technical and warranty reasons, we do not issue INVOICES but only regular receipts that must be kept for the purposes of the warranty of the items.  

The delivery of the goods will be carried out directly in the store (without any additional costs), or at the customer's request by means of an express courier indicated by the customer himself during the order phase, with charges as specified in the "Payment Methods" section. The goods will be shipped to the address indicated by the customer during the order phase, who must verify that the data reported on the order entry confirmation are correct and promptly communicate any errors. The customer is in any case aware that no responsibility can be attributed to Calico Jack for losses, delays in delivery, incorrect or incomplete addresses indicated by the customer himself.

The Calico Jack Staff checks and tests (where necessary) ALL items before shipping, especially replicas, which must absolutely be used with 7.4V Li.Po or 8.4V NiMh batteries, in order to guarantee their complete integrity and correct functioning.

Furthermore, for legal and transparency reasons, all stages of checking, testing and packaging of the items are filmed and certified before shipping in order to avoid unpleasant legal problems of any kind (the videos will be made available only upon request of the judiciary in the event of disputes). 

The packaging used by Calico Jack is suitable and sturdy to guarantee the integrity of the item for correct shipping, even recycled ones, in fact, Calico Jack has always promoted respect for the environment and uses (when possible) even old packaging still suitable for shipping.

Calico Jack, as previously stated, assumes no responsibility for damage to the goods sent resulting from shipping or for any losses.

In this regard, we recommend all our customers, for greater peace of mind, to use the shipment with INSURANCE ON THE GOODS and to always accept the goods with RESERVATION even if the packaging is not damaged or tampered with, to eventually recover from the courier for any damage to the items sent caused by transport (insured shipping allows compensation provided that the complaint is opened within 24 hours of receiving the goods).

Calico Jack will not be held responsible for shortages or damage in the event of failure to accept "WITH RESERVATION".

In case of delivery with the “Collect in store” method, Calico Jack will prepare the order and send the customer an “order ready confirmation” message. Orders with the "Collect in store with cash on delivery" option will be automatically cancelled if not collected within 7 days of the "order ready confirmation" message, unless the customer has agreed otherwise.

Payment methods

The accepted payment methods are: Cash on delivery (collection and payment via cash, PayPal, or instant bank transfer, directly in store or with shipping upon request), Credit Card, Paypal(involves commissions see below) and Normal Bank Transfer or instant (recommended).

Calico Jack is not responsible for any fraudulent or illicit use that may be made by third parties, of credit cards, checks and other means of payment, when paying for the products purchased.
Calico Jack, in fact, at no time during the purchase procedure is able to know the buyer's credit card number which, by opening a protected connection, is transmitted directly to the Banking Institute managing the service.

• CASH ON DELIVERY: METHOD USABLE ONLY WITH COLLECTION IN STORE OR ON EXPLICIT REQUEST! You pay the courier directly in cash upon delivery. You can also pick up and pay for the goods in cash directly at the store.

• PAYPAL: with a Paypal account or for those who do not have a Paypal account directly with their credit card, without registration. Attention! For this payment method, a commission is required by the Paypal service to be paid by the Customer and this commission can never be refunded (see conditions of the service on the official Paypal page). The Commission is detailed in the order receipt that you can find in your Account ... and also on the Paypal page added to the shipping costs.

Shipping Costs and Times

The shipping costs for Italy reported during the purchase are fixed up to a package of max 5kg, while for HIGHER weights and shipments abroad the costs will be communicated to you later. Calico Jack has been using the MBE (Mail Boxes Etc) transport services for years, which will choose the most suitable and most functional courier at the moment in your area of ​​belonging, to ensure the best possible service. It is also possible to use your own courier or collect the goods directly from our store in Muggiò (MB), by communicating it during the order phase, you will then be put in contact by our Staff to agree on the day of collection of the goods.

We remind you that the Calico Jack Staff checks and tests (where necessary) ALL items before shipping, especially replicas, which must absolutely be used with 7.4V Li.Po or 8.4V NiMh batteries, in order to guarantee their complete integrity and correct functioning. Furthermore, for legal and transparency reasons, all the phases of control, testing of the articles and their packaging are filmed and certified before shipping in order to avoid unpleasant legal problems of any kind (the videos will be made available only upon request of the judiciary in the event of disputes). 

Insurance and conditions in the event of loss or damage to the package:

As previously stated, Calico Jack recommends all its customers, for greater peace of mind, to use shipping with GOODS INSURANCE and to always accept the goods with RESERVATION even if the packaging is not damaged or tampered with, in order to possibly recover from the courier any damage to the items sent caused by transport.

ATTENTION: Calico Jack will not be held responsible for shortages or damages in the event of non-acceptance "WITH RESERVATION" and we assume no responsibility if the Insured shipment is not carried out (which however covers only the value of the goods and not the shipping and handling costs).

INSURE YOUR PACKAGE: and we will take responsibility for your shipment.

If your package is lost or damaged during shipping, by insuring it you will be entitled to the shipment of a product equal to the one ordered, if it is not available we will let you choose between a replacement product of equal value or a full refund of the cost incurred.

The request for compensation will be accepted only if you have signed "WITH RESERVATION" to the courier, or if the package is lost by the courier itself, therefore it will be considered undelivered.

If you decide not to insure your package we will not be held responsible for the shipment, and you will be entitled to the basic refund of the courier that It is equivalent to approximately 0.50 cents per kg in weight/volume ratio (for example, the packaging of an M4 replica develops between 12 and 16 kg in weight/volume ratio), it would mean a refund equal to 6/8€.

Once the document has been signed by the courier, the Customer will not be able to raise any objections regarding the external characteristics of the goods delivered.

We remind you that shipping costs are the responsibility of the recipient, unless otherwise agreed with the customer for particular reasons.

Right of withdrawal and Return Conditions

Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his/her professional activity, or does not make the purchase by indicating a VAT number in the notes of the order form to calicojack.it), he/she has the right to withdraw from the purchase contract for any reason within 14 days of receiving the goods.

Any returns must be authorised by Calico Jack Customer Service, which will issue a return authorisation number (RMA) and insert it in the package and ship it to our office, failure to observe this operation will lead to a longer management of the return.

Or a registered letter with acknowledgement of receipt can be sent within 14 days from the date of receipt of the goods to: Calico Jack sas with headquarters in Via G. Galilei 4 - 20835 Muggiò (MB), or send an e-mail indicating the order reference to: assistenza@calicojack.it, subsequently you will receive an e-mail from us with the necessary instructions for the return.

The costs associated with the return are entirely borne by the customer (shipping cost to our store + control and storage costs equal to €15 for orders placed from Italy and €25 for orders placed in Europe and Extra Eu).

The right of withdrawal is however subject to the following conditions:

1) The Customer has 14 days to request the return by email to assistenza@calicojack.it another 14 from the request to ship the goods, if at least one of these 2 terms is exceeded it will no longer be possible to use the return request;

2) The right does not apply to sealed products, batteries, biodegradable consumables;

3) The purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the application of labels or adhesive tape directly on the original packaging of the Item must be avoided.

4) The costs associated with the return (shipping + control and storage) are the responsibility of the customer;

5) Items returned for incompatibility (not subject to our item) or for repairs under warranty, but found to be functioning and compatible, or found to be tampered with, will be subject to a flat rate charge of € 25.00 for management costs, in addition to the return management costs;

6) The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;

7) In the event of damage to the goods during transport, Calico Jack will notify the customer of the incident (within 2 working days of receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the goods (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal;

9) Calico Jack is not liable in any way for damage or theft/loss of goods returned with uninsured shipments;

10) Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport.

11) Without prejudice to any repair costs for damage found to the original packaging, Calico Jack will refund the customer the amount already paid for the purchase of the goods, within 14 days after your return, through the reversal procedure of the amount charged to the payment card or by bank transfer. In the latter case, it will be the customer's responsibility to promptly provide the bank details on which to obtain the refund (IBAN code and Bank of the holder of the Order Receipt)

12) The right of withdrawal lapses completely, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Calico Jack ascertains:

_ The lack of the external packaging and/or the original internal packaging;

_ The absence of integral elements of the product (accessories, cables, manuals, parts, ...);

_ Damage to the product for reasons other than its transport;

_ Restoration of packaging or wrapping not possible;

_ That the object has been dismantled and/or tampered with;

In the event of forfeiture of the right of withdrawal, the goods will remain at the Calico Jack headquarters, available to the Customer for collection at his/her own expense. load.

The credit in favor of the customer may be partial in the event that the goods have suffered a decrease in value, such as for example:

_ Non-diligent use of the product;

_ Even partial use of the goods and any consumables;

_ Damaged packaging or in any case not intact as received;

ATTENTION: If a package is refused upon delivery, the shipping costs, payment management, insurance, and all related costs will still be charged to the customer for the entire amount incurred (i.e. our actual cost incurred, including our management), so upon return of the goods to our office, the actual cost to be incurred will be calculated and communicated.

If an electronic payment system was used, this amount (after prior communication) will be deducted from the refund, if instead the payment was in cash on delivery, you will be asked to pay the amount within a certain period of time and in the event of non-payment, the case will be entrusted to our lawyer for debt collection.

For transparency, we inform you that the cost maximum you should pay will be €25 for standard shipments in Italy and €50 for shipments outside Italy, or Italy in remote locations and smaller islands such as Venice Lagoon, Livigno, Campione d'Italia etc... 

Replicas and Various Items Warranty

Given that all the items dealt with are in COMPLIANCE WITH THE ITALIAN LAW IN FORCE, tall the items sold by Calico Jack Softair are covered by the manufacturer's conventional warranty (generally valid for 12 months unless otherwise specified) and the 24-month guarantee for defects of conformity, pursuant to Legislative Decree 24/02.

Attention! as regards replicas, the warranty covers only the rifle, while any accessories present in the box such as batteries, battery chargers, straps or grips and so on, are free of charge from the manufacturer and are therefore not subject to any type of warranty.

To benefit from warranty assistance, the Customer must keep the proof of purchase (receipt attached to the Order receipt).

The warranty pursuant to Legislative Decree 24/02 applies to the product that presents a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. In the event of a lack of conformity, Calico Jack will, at no cost to the Customer, restore the conformity of the product by repairing/replacing it at an Authorized Service Center of the Official Importer. If, following intervention by an Authorized Assistance Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged for any costs of verification and restoration requested by the Authorized Assistance, as well as transport costs if incurred by Calico Jack Softair.

In the event that, for any reason, Calico Jack is unable to return to its customer a product under warranty (repaired or replaced), Calico Jack may proceed at its own discretion to refund the amount paid taking into account the use of the good or to replace it with a product of equal or superior characteristics.

The times of repair or possible replacement of the Article depend exclusively on the policies of the manufacturer and no damages can be requested from Calico Jack for any delays in carrying out repairs or replacements.

In cases where the application of the guarantees provides for the return of the Article, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the application of labels or adhesive tape directly on the original packaging of the Article must be avoided.

Signs of wear, discoloration and any possible aesthetic sign due to use or simple handling cannot be considered a defect.

Procedure instructions:

1) Send a communication via e-mail to assistenza@calicojack.it, entering the number order;

2) Verify that the conditions exist to proceed with the return (see complete conditions of sale)

3) Insert in the package a copy of the PURCHASE RECEIPT, Order Receipt and two written lines of the problem encountered, and proceed with the shipment of the well-packaged item to the address: Negozio Calico Jack sas - Via G. Galilei 4 - 20835 Muggiò (MB);

However, the buyer is responsible forthe shipping costs for the defective item, which must be sentadequately packaged with its original box integrated, complete with manual and all other accessory present at the time of purchase.

Attention! If it is found that the defective item has been dismantled or tampered with in any way, any form of warranty for the same will expire. 

N.B. we will not be responsible for returned products until they arrive at our store, we recommend that you make insured shipments.

Products that are not covered by the warranty (for example, repairs under warranty that are then found to be functional and compatible, or that have been tampered with) will be subject to a flat rate charge of €25.00 for management costs, in addition to the return management costs.

Online Discounts 

Calico Jack periodically offers discounts of various types and durations on its online site. Discounts can be applied to all items or individually, and can only be applied to certain groups of items or certain categories of items.

When the wording "Online Only" appears next to the price of a discounted item, it means that the offer is reserved only for purchases made directly online and therefore the discount is not active in the physical store (the price in the store is always the one crossed out unless otherwise specified). Calico Jack reserves the right, for any reason and at any time, to suspend in part or in full the publication of discounts, without giving any notice or explanation.

Changes to the Conditions and prices displayed

Calico Jack reserves the right, at any time and without giving any notice, to modify the prices displayed in the catalog, the terms and conditions, or insert new terms regarding access to the Site or its use. Such changes and additions, once published, are immediately effective;

If you use the Site after the publication of changes or additions to the Conditions and prices shown in the catalog, you accept the changes or additions and are bound by them.

Obligations of the Buyer

The consumer undertakes, once the online purchase procedure has been concluded, to print and keep these conditions of sale, which, moreover, he/she will have already viewed and accepted before the purchase, as well as the specifications of the product being purchased, in order to fully satisfy the condition referred to in art. 3 and 4 of Legislative Decree No. 185/1999.
The buyer is strictly prohibited from entering false and/or invented and/or imaginary data in the registration procedure required to activate the process for the execution of this contract and the related further communications; the personal data and e-mail address must be exclusively their real personal data and not those of third parties or imaginary data.
It is expressly forbidden to make double registrations corresponding to a single person or to enter data of third parties.
Calico Jack reserves the right to legally pursue any violation and abuse, in the interest and for the protection of ordinary consumers.
